TRUKED PRIVACY POLICY
This Privacy Policy describes how Bobcat Technology Consultants, LLC, doing business as Truked (“Truked,” “Company,” “we,” “us,” or “our”), collects, uses, discloses, retains, and protects personal information in connection with the Truked mobile application, website, platform, technology, content, features, communications, payment functionality, claims processes, and related services (collectively, the “Service”).
This Privacy Policy applies to individuals and entities who access or use the Service, including Customers, Drivers, applicants to become Drivers, visitors to our website, and any other users of the Service (collectively, “Users,” “you,” or “your”).
This Privacy Policy is incorporated into and forms part of Truked’s User Terms and Conditions and Driver Terms and Conditions. Capitalized terms not defined in this Privacy Policy have the meanings given to them in the applicable Terms.
By accessing or using the Service, creating an Account, requesting a Job, applying to become a Driver, accepting or performing a Job, submitting information to Truked, or otherwise interacting with the Service, you acknowledge that Truked may collect, use, disclose, retain, and protect personal information as described in this Privacy Policy.
If you do not agree with this Privacy Policy, you should not access or use the Service.
1. SCOPE OF THIS PRIVACY POLICY
This Privacy Policy applies to personal information we collect from or about:
Customers who request transportation services through the Service;
Drivers who apply to, register for, accept, reserve, or perform Jobs through the Service;
individuals who visit Truked’s website or use the mobile application;
individuals who communicate with Truked, Customers, Drivers, or support personnel;
individuals involved in claims, disputes, incidents, accidents, insurance matters, or legal compliance matters; and
individuals whose information is submitted to Truked by another User, such as an authorized representative present at pickup or delivery.
This Privacy Policy does not apply to third-party websites, platforms, payment processors, background check providers, insurance carriers, app stores, mapping providers, or other third-party services that may have their own privacy policies.
2. PERSONAL INFORMATION WE COLLECT
We may collect the categories of personal information described below.
2.1 Account and Contact Information – We may collect information such as:
name;
email address;
phone number;
mailing address;
billing address;
Account username or credentials;
profile information;
communication preferences; and
other information you provide when creating or maintaining an Account.
2.2 Customer Information – If you use the Service as a Customer, we may collect:
pickup and delivery addresses;
requested pickup and delivery times;
Job details;
item descriptions;
item size category;
photographs of items, locations, or loads;
information about access conditions, stairs, elevators, parking, loading areas, storefronts, curbside pickup, ground-level entry areas, or Inside Delivery requests;
payment-related information;
cancellation, refund, quote adjustment, and claims information;
ratings, reviews, messages, and support communications; and
information about representatives or other adults designated by you to assist with pickup, loading, unloading, or delivery.
2.3 Driver Information – If you apply to become or use the Service as a Driver, we may collect:
name, email address, phone number, and address;
date of birth;
driver’s license information;
vehicle information, including make, model, year, license plate, registration, inspection status, vehicle category, and photographs;
insurance information, including proof of insurance and coverage details;
tax information, including taxpayer identification information where required;
payment and payout information;
banking or payment account information;
background check, driving record, identity verification, or eligibility information, where applicable;
Job acceptance, reservation, cancellation, completion, and performance information;
location information;
ratings, reviews, complaints, safety reports, incident reports, and claims history;
communications with Customers and Truked; and
other information needed to evaluate, approve, manage, support, or administer Driver access to the Service.
2.4 Job, Load, Photo, and Delivery Information – We may collect information relating to Jobs, including:
pickup and delivery locations;
dates and times;
route, distance, and mileage information;
load descriptions;
photographs uploaded by Customers or Drivers;
proof-of-pickup and proof-of-delivery information;
delivery confirmations;
quote adjustment information;
cancellation and no-show information;
access, safety, parking, loading, and unloading details; and
information needed to verify performance, resolve disputes, administer claims, and enforce the Terms.
2.5 Location Information – We may collect approximate or precise location information from your device or from information submitted through the Service, including:
pickup and delivery addresses;
GPS or device location data;
Driver location before, during, or after a Job, where enabled;
route and travel information;
location timestamps; and
other location-related information needed to operate the Service.
We may use Driver location information to match Jobs, provide Customer updates, verify arrival and completion, support safety, investigate disputes, administer claims, prevent fraud, and improve the Service.
You may be able to disable certain location permissions through your device settings, but doing so may limit or prevent your ability to use certain Service features.
2.6 Payment, Billing, and Payout Information – We may collect information relating to payments and payouts, including:
payment method information;
billing details;
transaction amounts;
authorization, capture, charge, refund, adjustment, chargeback, and payout history;
tips;
cancellation fees;
quote adjustments;
tax and reporting information;
payment processor identifiers; and
fraud prevention or payment risk information.
Truked may use third-party payment processors. We generally do not store complete payment card numbers, which are handled by our payment processors subject to their own terms and privacy policies.
2.7 Communications and Support Information – We may collect communications and support information, including:
messages between Customers and Drivers through the Service;
emails, text messages, push notifications, and in-app messages;
phone call records or call metadata, where applicable;
support tickets;
complaints;
dispute communications;
claims communications;
safety reports; and
other communications with Truked, Customers, Drivers, insurers, claims administrators, or third-party service providers.
We may monitor, access, review, retain, and use communications for support, safety, quality assurance, fraud prevention, dispute resolution, claims administration, legal compliance, and enforcement of the Terms.
2.8 Claims, Insurance, Incident, and Safety Information – If a Job results in a claim, complaint, dispute, accident, damage, loss, theft, delay, injury, or other incident, we may collect:
claim forms and claim details;
photographs and videos;
proof of ownership;
proof of value;
receipts;
repair estimates;
item descriptions;
pickup and delivery information;
Driver and Customer statements;
police reports or incident reports;
insurance information;
communications with insurers or claims administrators;
settlement, denial, reimbursement, or payment information; and
other information reasonably necessary to investigate, administer, resolve, or defend claims.
2.9 Device, Usage, and Technical Information – We may automatically collect information when you use the Service, including:
IP address;
device identifiers;
browser type;
operating system;
app version;
pages or screens viewed;
referring URLs;
clickstream data;
log files;
access times;
crash reports;
diagnostics;
cookies and similar technologies; and
information about how you interact with the Service.
2.10 Ratings, Reviews, and User Content – We may collect User Content submitted through the Service, including:
ratings;
reviews;
comments;
photographs;
item descriptions;
profile information;
messages;
incident reports;
support communications; and
other content, information, or materials submitted by Users.
User Content may contain personal information. Our handling of personal information contained in User Content is governed by this Privacy Policy.
2.11 Information from Third Parties – We may receive or collect personal information directly from you; from other Users, such as Customers, Drivers, or authorized representatives; automatically from your device or your use of the Service; from service providers, payment processors, background check providers, identity verification providers, mapping and location providers, insurers, claims administrators, app stores, analytics providers, and fraud prevention providers; from publicly available sources; and from government agencies, law enforcement, courts, regulators, or other third parties where applicable.
3. HOW WE USE PERSONAL INFORMATION
We may use personal information for the purposes described below.
3.1 To Provide and Operate the Service – We may use personal information to:
create, maintain, and administer Accounts;
allow Customers to request Jobs;
allow Drivers to accept, reserve, and perform Jobs;
match Customers with Drivers;
process bookings, quote adjustments, cancellations, refunds, and payments;
process Driver payouts;
provide pickup, delivery, location, and Job status information;
enable communications between Customers, Drivers, and Truked;
provide Customer and Driver support;
administer ratings, reviews, and User Content; and
otherwise operate the Service.
3.2 To Evaluate and Manage Driver Eligibility – We may use Driver information to:
process Driver applications;
verify identity;
verify driver’s license, vehicle, insurance, and other eligibility information;
conduct background checks or driving record checks, where applicable and authorized;
evaluate continued Driver eligibility;
administer Driver Accounts;
detect fraud or unsafe conduct;
manage Driver access to Jobs; and
suspend, restrict, deactivate, or terminate Driver access where appropriate.
3.3 To Process Payments, Payouts, and Financial Transactions – We may use personal information to:
authorize, charge, capture, release, adjust, or refund Customer payments;
process Driver payouts;
administer tips;
process cancellation fees, waiting time fees, quote adjustments, tolls, taxes, surcharges, and other amounts;
detect and prevent payment fraud;
respond to chargebacks or payment disputes;
comply with tax, accounting, and reporting obligations; and
work with payment processors and financial institutions.
3.4 To Administer Claims, Insurance, Disputes, and Safety Matters – We may use personal information to:
receive, investigate, administer, settle, deny, or otherwise resolve claims;
evaluate loss, theft, damage, delay, misdelivery, non-delivery, injury, property damage, or other incidents;
communicate with Customers, Drivers, insurers, claims administrators, legal counsel, and other relevant parties;
verify Job details and item condition;
preserve evidence;
process insurance-related matters;
support safety investigations;
defend or pursue legal claims; and
enforce the Terms and applicable policies.
3.5 To Communicate with You – We may use personal information to send:
transactional messages;
Job updates;
Driver arrival and status notifications;
payment, payout, refund, and claims communications;
safety notices;
legal notices;
Account notices;
policy updates;
support communications;
promotional communications, where permitted by law; and
surveys or feedback requests.
You may opt out of certain promotional communications, but you may still receive transactional, administrative, legal, safety, payment, claims, and Account-related communications.
3.6 To Improve, Protect, and Develop the Service – We may use personal information to:
analyze Service usage;
improve functionality, design, and user experience;
develop new features;
monitor performance;
troubleshoot errors;
conduct analytics;
prevent fraud, abuse, misuse, and security incidents;
protect Truked, Users, and the public;
enforce platform rules; and
maintain the integrity and security of the Service.
3.7 For Legal, Compliance, and Business Purposes – We may use personal information to:
comply with applicable laws, regulations, court orders, subpoenas, and legal processes;
respond to law enforcement or government requests;
enforce the User Terms and Conditions, Driver Terms and Conditions, and other policies;
investigate fraud, abuse, safety issues, or violations;
exercise or defend legal rights;
comply with insurance, tax, accounting, and audit obligations;
evaluate or complete a merger, acquisition, financing, restructuring, sale of assets, or similar transaction; and
protect the rights, safety, and property of Truked, Users, service providers, and others.
4. HOW WE DISCLOSE PERSONAL INFORMATION
We may disclose personal information as described below.
4.1 Between Customers and Drivers – To facilitate Jobs, we may disclose relevant information between Customers and Drivers, including:
names or profile information;
pickup and delivery locations;
Job details;
item descriptions and photographs;
contact or communication information;
Driver status, location, and arrival information;
vehicle information;
ratings and reviews;
quote adjustment information; and
information needed to coordinate pickup, loading, transportation, unloading, and delivery.
4.2 Service Providers – We may disclose personal information to service providers that help us operate the Service, including:
payment processors;
background check providers;
identity verification providers;
cloud hosting providers;
analytics providers;
customer support providers;
mapping and location providers;
communications providers;
fraud prevention vendors;
insurance carriers;
claims administrators;
legal, accounting, tax, and professional advisors; and
other vendors that support our business operations.
These service providers may process personal information on our behalf or in accordance with their own legal obligations.
4.3 Insurers, Claims Administrators, and Relevant Parties
We may disclose personal information to insurers, claims administrators, Customers, Drivers, repair providers, investigators, law enforcement, legal counsel, and other relevant parties as necessary to investigate, administer, resolve, defend, or process claims, disputes, incidents, accidents, or insurance matters.
4.4 Payment Processors and Financial Institutions
We may disclose payment, billing, transaction, payout, tax, fraud, and chargeback information to payment processors, banks, card networks, financial institutions, and related providers.
4.5 Legal and Compliance Disclosures – We may disclose personal information if we believe disclosure is reasonably necessary to:
comply with law;
respond to legal process;
cooperate with law enforcement or government authorities;
enforce the Terms or policies;
investigate fraud, safety issues, misconduct, or unlawful activity;
protect the rights, safety, and property of Truked, Users, or others; or
establish, exercise, or defend legal claims.
4.6 Business Transactions
We may disclose or transfer personal information in connection with a merger, acquisition, reorganization, financing, sale of assets, bankruptcy, or similar business transaction involving all or part of Truked’s business.
4.7 With Your Consent or Direction
We may disclose personal information with your consent or at your direction.
4.8 Category, Purpose, and Recipient Mapping
The categories of personal information described in Section 2 may be used for the purposes described in Section 3 and disclosed to the categories of recipients described in this Section 4, depending on the User, Job, feature, transaction, claim, request, or legal requirement involved. For example, Account, contact, Customer, Driver, Job, location, payment, communications, claims, device, usage, and User Content information may be disclosed to other Users, service providers, payment processors, background check and identity verification providers, mapping and location providers, insurers, claims administrators, professional advisors, government authorities, law enforcement, parties to business transactions, and other parties with your consent or as otherwise described in this Privacy Policy.
5. COOKIES, ANALYTICS AND SIMILAR TECHNOLOGIES
We and our service providers may use cookies, pixels, software development kits, analytics tools, log files, device identifiers, and similar technologies to:
operate the Service;
remember preferences;
authenticate users;
analyze traffic and usage;
measure performance;
detect fraud and security issues;
improve the Service; and
support marketing and communications.
You may be able to adjust cookie or tracking settings through your browser or device. Some settings may affect Service functionality. Truked does not sell personal information for money. However, if Truked or its service providers use cookies, pixels, software development kits, analytics tools, advertising technologies, or similar technologies in a manner that is considered a “sale,” “sharing,” or targeted advertising under applicable law, you may have the right to opt out of that activity. Where required by applicable law, Truked will process recognized browser-based or device-based opt-out preference signals, such as Global Privacy Control or similar signals, in accordance with applicable legal requirements and available technical standards.
6. LOCATION INFORMATION
The Service may rely on location information to function properly, particularly for Drivers and active Jobs. We may collect, use, and disclose location information to:
match Customers and Drivers;
show Driver availability;
provide estimated arrival information;
verify pickup, transit, and delivery;
support routing and navigation;
assist with safety and support;
investigate disputes or claims;
detect fraud or misuse; and
improve the Service.
If you disable location permissions, certain Service features may not work properly or may be unavailable.
7. PHOTOGRAPHS, LOAD IMAGES AND PROOF OF DELIVERY
Customers may be required or permitted to upload photographs of items, loads, pickup conditions, delivery conditions, or related Job details. Drivers may be required or permitted to upload photographs for proof of pickup, proof of delivery, item condition, claims, support, safety, or dispute purposes. We may use photographs to:
help Drivers evaluate Jobs;
verify Job details;
document item condition;
support quote adjustments;
administer claims;
resolve disputes;
provide support;
prevent fraud;
enforce the Terms; and
comply with legal or insurance obligations.
Photographs may contain personal information, including images of items, homes, businesses, addresses, license plates, people, or other identifiable details. Please avoid submitting unnecessary personal, sensitive, or confidential information in photographs.
8. BACKGROUND CHECKS AND DRIVER VERIFICATION
If you apply to become a Driver or use the Service as a Driver, Truked may use third-party providers to conduct identity verification, background checks, driving record checks, license verification, insurance verification, or other screening.
Where required by law, Truked will provide separate disclosures and obtain separate authorizations before obtaining background checks, consumer reports, investigative consumer reports, or similar reports.
Information obtained through verification or screening may be used to evaluate Driver eligibility, support safety, prevent fraud, comply with law, administer insurance requirements, and manage Driver access to the Service.
9. PAYMENT PROCESSING
Truked may use third-party payment processors to process Customer payments and Driver payouts.
Payment processors may collect, process, and store payment card information, bank account information, payout information, tax information, identity verification information, and other transaction-related information. Their processing of personal information may be governed by their own terms and privacy policies.
Truked may receive transaction identifiers, limited payment information, billing details, payout status, refund information, chargeback information, fraud signals, and related information from payment processors.
10. COMMUNICATIONS AND SMS
By using the Service, you may receive communications from Truked by email, SMS/text message, push notification, in-app message, telephone, mail, or other reasonable means.
Communications may include:
Account messages;
Job notifications;
Driver arrival updates;
payment and payout notices;
safety notices;
claims communications;
support responses;
legal notices;
policy updates; and
promotional messages where permitted by law.
You may opt out of certain promotional messages as instructed in the message. Even if you opt out of promotional messages, you may still receive transactional, administrative, legal, safety, claims, payment, and Account-related communications.

11. USER CONTENT, RATINGS AND REVIEWS
The Service may allow Users to submit User Content, including reviews, ratings, comments, photographs, item descriptions, profile information, messages, and other materials.
User Content may be visible to other Users or the public depending on the feature, context, and applicable settings. For example, ratings, reviews, profile information, Driver status information, vehicle information, and Job-related information may be shared to operate the Service.
We may use, moderate, remove, restrict, or disable User Content as described in the User Terms and Conditions and Driver Terms and Conditions.
Please do not submit User Content containing personal information about others unless you have the right to do so.
12. DATA RETENTION
We retain personal information for as long as reasonably necessary to fulfill the purposes described in this Privacy Policy, including to:
provide and operate the Service;
maintain Accounts;
administer Jobs;
process payments and payouts;
comply with tax, accounting, insurance, and legal obligations;
administer claims and disputes;
prevent fraud and abuse;
enforce the Terms;
resolve disputes;
maintain business records; and
exercise or defend legal rights.
Retention periods may vary depending on the type of information, the nature of the relationship, legal requirements, claims considerations, insurance requirements, and operational needs.
We may retain certain information after Account deletion or termination where reasonably necessary for legal, tax, accounting, fraud prevention, safety, insurance, dispute resolution, claims, or enforcement purposes.
13. SECURITY
We use reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, disclosure, alteration, or destruction.
However, no system, network, application, or method of transmission or storage is completely secure. We cannot guarantee absolute security of personal information.
You are responsible for maintaining the confidentiality of your Account credentials and for promptly notifying Truked of any unauthorized access to or use of your Account.
14. YOUR CHOICES
Depending on your location and applicable law, you may have choices regarding your personal information.
14.1 Account Information
You may be able to access, update, or correct certain Account information through the Service or by contacting Truked.
14.2 Location Permissions
You may be able to enable or disable location permissions through your device settings. Disabling location permissions may limit Service functionality, especially for Drivers.
14.3 Communications
You may opt out of certain promotional communications by following the instructions in those communications. You may still receive transactional, administrative, legal, safety, claims, payment, and Account-related communications.
14.4 Cookies
You may be able to manage cookies through your browser or device settings. Disabling cookies may affect Service functionality.
14.5 Account Deletion
You may request Account deletion by contacting Truked or using available Service features. We may retain certain information as described in the Data Retention section.
15. PRIVACY RIGHTS
Depending on your state, country, or other jurisdiction, you may have certain privacy rights, which may vary by state or other applicable law and may include the right to:
access personal information;
correct inaccurate personal information;
delete personal information;
obtain a copy of personal information;
opt out of certain processing activities;
restrict or object to certain processing;
appeal a privacy request decision; and
not be discriminated against for exercising privacy rights.

Truked does not sell personal information for money. If Truked uses cookies, pixels, software development kits, analytics tools, advertising technologies, or similar technologies in a manner that constitutes a “sale,” “sharing,” or targeted advertising under applicable law, you may have the right to opt out of that processing. Where required by applicable law, Truked will process recognized browser or device opt-out preference signals, such as Global Privacy Control or similar signals, in accordance with applicable legal requirements.
Where required by applicable law, Truked may provide supplemental state-specific privacy notices or disclosures that describe additional rights, disclosures, or processes applicable to residents of particular states. Those supplemental notices, if provided, should be read together with this Privacy Policy.
You may submit a privacy request through an authorized agent where permitted by applicable law. Truked may require the agent to provide proof that you authorized the agent to act on your behalf, and we may require you to verify your identity directly with Truked or confirm that you provided the agent with permission to submit the request.
If Truked denies or otherwise acts on a privacy request and applicable law gives you a right to appeal, you may appeal the decision by contacting us using the contact information below and describing the request and the decision you are appealing. Truked will review and respond to appeals as required by applicable law.

16. SENSITIVE PERSONAL INFORMATION
We may collect certain information that may be considered sensitive under applicable law, including precise location information, driver’s license information, insurance information, tax information, background check information, and certain claims or incident information.
We use sensitive personal information only as reasonably necessary to provide the Service, verify Driver eligibility, process payments and payouts, administer claims, support safety, prevent fraud, comply with law, and for other purposes permitted by applicable law.
17. CHILDREN’S PRIVACY
The Service is not intended for individuals under eighteen (18) years old. We do not knowingly collect personal information from children under 18. If we learn that we have collected personal information from a child under 18 without appropriate authorization, we will take reasonable steps to delete the information.
18. THIRD-PARTY SERVICES
The Service may link to or integrate with third-party websites, platforms, app stores, payment processors, mapping services, background check providers, insurance providers, communication tools, analytics providers, or other third-party services.
Truked does not control and is not responsible for the privacy practices of third parties. Your use of third-party services may be subject to separate terms and privacy policies.
19. DE-IDENTIFIED OR AGGREGATED INFORMATION
We may create, use, disclose, or retain de-identified, anonymized, or aggregated information that does not reasonably identify you. We may use such information for analytics, research, business, safety, operational, marketing, and Service improvement purposes.
20. INTERNATIONAL USERS
The Service is operated from the United States. If you access or use the Service from outside the United States, you understand that your personal information may be processed in the United States or other jurisdictions where privacy laws may differ from those in your location.
21. CHANGES TO THIS PRIVACY POLICY
Truked may update or modify this Privacy Policy from time to time. If we make material changes, we may provide notice through the Service, by email, by posting an updated Privacy Policy, or by other reasonable means.
Your continued use of the Service after an updated Privacy Policy becomes effective constitutes your acknowledgement of the updated Privacy Policy, to the extent permitted by applicable law.
If you do not agree with the updated Privacy Policy, you must stop using the Service.
